[ARCHIVED] Update on Homicide

The investigation into Tuesday morning’s homicide continues by the New Braunfels Police Department Criminal Investigations Division.  Detectives and Crime Scene Technicians have been interviewing witnesses, collecting evidence, and coordinating with the San Antonio Police Department along with other area law enforcement agencies.

The female victim from Tuesday’s homicide has been identified as 33-year old Marisol Martinez from Austin and next of kin has been notified.  The investigation so far has revealed that the suspect and the victim had previously been in a relationship and that the victim had a protective order issued against the suspect stemming from a family violence/strangulation incident from March of 2019.

The suspect, identified as 32-year old Sacramento Martinez of Austin, was initially taken into custody by San Antonio Police Tuesday morning and held at the Bexar County Jail on a warrant related to the family violence incident.  New Braunfels Police Detectives have since been able to obtain an arrest warrant for Martinez charging him with Capital Murder.

Investigators believe that Martinez first shot and killed Marisol Martinez, leaving her inside of a black Ford Expedition that was parked on the inside shoulder in the 3900 block of I-35 North.  Martinez then fled from that area on foot across the highway towards the TA Truck Stop in the 4800 block of I-35 North.  Investigators believe he then shot the driver of an 18-wheeler, stole the truck, and fled from the truck stop at a high rate of speed.  The 18-wheeler later crashed in San Antonio, Martinez fled the scene on foot, and the original driver of the truck was found deceased inside.  The victim has since been identified as 45-year old Daniel Sieger of Mission, Texas, and next of kin has been notified.

In Texas, a charge of Capital Murder can be made when more than one person is killed during the course of a criminal episode, or if a person commits homicide while also committing another felony (see Texas Penal Code Sec. 19.03).  The warrant charging Martinez with Capital Murder has been served and he is currently being held without bond.  Martinez is now awaiting transfer to the Comal County Jail and additional charges may be pending.

The New Braunfels Police Department would like to thank the numerous law enforcement agencies that continue to assist with this ongoing investigation, including the San Antonio Police Department, the Comal County Sheriff’s Office, the Travis County Sheriff’s Office, and the Austin Police Department.  This incident remains an ongoing investigation by the New Braunfels Police Department and no further information is expected to be released.
